 RESOLUTION NO. 23-11
SERIES OF 2011

            WHEREAS, the Philippine Racing Commission (Philracom) has the exclusive jurisdiction and control over the conduct of horseracing including the framing and scheduling of races, the construction and safety of horse-racing, the allocation of prizes and the security of racing as provided in Presidential Decree No. 420;

            WHEREAS, the said mandate, while considerably encompassing, does not include the power to suspend or penalize non- Philracom licensees who may have committed infraction, negligence, misdemeanor or other similar offense;

            WHEREAS, there were incidents in the past that involved non-Philracom licensees but employees of the racing clubs who committed infractions, negligence or offenses on which the Philracom is called upon to act on;

            WHEREAS, the aforesaid incidents/circumstances are outside of the power to impose suspensions or penalties granted to Philracom by Presidential Decree No. 420, thus, fall within the scope of the authority and responsibility of the racing clubs who employ them where such incidents/circumstances occur;

            NOW THEREFORE, BE IT RESOLVED, AS IT IS HEREBY RESOLVED, that infractions, negligence, misdemeanor or offenses committed in the premises of a Racing Club by its employee, a non-Philracom licensee, shall be the sole responsibility of the Racing Club where the said incident occurred; and the Philracom shall not assume authority nor exercise its authority thereover in view of legal constraints.

            RESOLVED FURTHER, that the Philracom Board of Commissioners reserves the right to impose fine/penalty, upon its discretion, upon the Racing Manager and Club Handicapper concerned should the infraction, negligence, misdemeanor or offense committed by its employee result in the disruption of the racing business/meet or affect the day to day activities of racing.

            RESOLVED FINALLY, that a copy of this Resolution be furnished the Racing Clubs and other concerned parties for their proper guidance and information.
